Kathmandu – The Supreme Court of Nepal has issued a show-cause order in four separate habeas corpus petitions, including one filed on behalf of medical entrepreneur Durga Prasai.
A single bench of Justice Kumar Regmi conducted a preliminary hearing on the petitions on Tuesday and directed the authorities to submit a written explanation within 24 hours of receiving the court’s notice, excluding travel time. The court has also ordered that the original case files related to the investigation be presented along with the response, clarifying the legal grounds for keeping the detainees in custody.
Advocate Suresh Bohara filed the habeas corpus petition at the apex court, claiming that Prasai has been held in unlawful detention. Similar petitions were also lodged on behalf of Ishwar Dahal, Yukendra Shrestha, and Gokul Parajuli, alleging that they too have been detained illegally.
Following the hearing, the court directed the concerned authorities — including the Ministry of Home Affairs and the Nepal Police Headquarters — to furnish written explanations through the Office of the Attorney General, stating the reasons for the detentions.
The court’s order requires the authorities to justify the legality of the arrests and continued detention of the individuals named in the petitions.
